What can i do if my employer takes to much money out for rent and refuses to give it back to me?

so my employer is my landlord also and he automatically withdraws my rent from my check and he withdrew too much one month do to the fact we got 3 checks in that month… and now he refuses to give it back can i do anything about it?

They have undue influence over you. If I were you, I’d call an employment attorney.
And you say that he won’t return it…..you see this is why it’s illegal.
Next thing you know, the employer will be throwing you down into some basement and feeding you through a hole inthe wall and letting you out just to work!
This is why it’s illegal. even if you signed something that says that they can and that you understand.
Remember, he/she has undue influence over you. controll etc.
I would check both local laws and for a paper trail first but, you could simply file a suit against him in a small claims court.
In Montana, you could take action via small claims court (link below). Having a lease is helpful. However, I’m surprised that he is refusing to give it back. Having 3 checks in a month happens every so often and normal people know this.
I think before you take action you need to talk to this guy again. I’ll say this because I don’t know you personally: don’t swear, raise your voice, or lose control. Smile. Explain to him your rent isn’t a percentage it’s a fixed rate. Ask him this: What would you do? How would you respond or take this? It personalizes it.
