If I owe back rent for an apartment and i pay it before the court date do i still get evicted?

My roommate didn’t pay his half of rent for three months and now we owe back rent and are getting evicted. On the summons it says that we owe $1,304 in back rent. If i pay all of that before the court date will the judge dismiss the eviction and will I get to stay in my apartment?

You would have to speak to the landlord. He is the one pushing the issue. The judge is only going to decide whether or not he has the right to evict you and when you have to get out. If you can try and talk to the landlord that would be the only way to get out of it. An eviction on your record can really screw you if you want to get section 8, housing, reduced rent, etc. in the future. They won’t let you with an eviction on your record.
Usually it up to the Landlord, They would want all the fees and and court fees paid as well. However if they want you out it wont matter to them.
The best thing would be to discuss this w/your landlord. I’m sure he/she has better things to do than to go to court. If you have the money owed in full, take it w/you in cash, & as you’re asking the question, begin taking the money you have & offer it to him. It’s hard to not accept cash rite in front of you! I honestly believe if you have the money to pay the rent, there is no “cause” for an eviction. It w/have been satisfied. Now if the landlord no longer wants you there, that’s a different story. He w/let you know he no longer chooses for you to be a tenant. I would go talk to the landlord before the date of the hearing. Best to you…
Usually you still get evicted, but paying will save you from going to court and having the rental company sue you.

Usually the judge will leave it up to the landlord. If the landlord is willing to accept your back rent…then yes, you will avoid the eviction. However since you’ve shown yourself to be a risky tenant, I doubt the landlord will accept.
