How do i get my rent deposit back?

My landlord in california is keeping my deposit. I have moved back east now and it would be difficult to sue her. She states that the carpet in the apt has a stain and needs to be replaced. It will cost 1400 to replace it…my entire deposit. She is putting the house on the market, and I am sure she wants new carpet to help the resale value. Is there anything I can do? There may be a stain there, but it is only slightly beyond normal wear and tear. The carpet cleaners failed to get the stain out;m they say it is coming from the mat underneath. I am a busy physician, and I think she knows that I won’t have time to come back to cali to settle it in court. If I do go back, would it be worth it? Incidently, there is a 21d limit to return one’s deposit in cali, and it has been 6 wks.

You might want to send her a letter from a lawyer to see if that produces any results. If you go to small claims, the amount of damages (I believe) is 3 times the deposit if she failed to provide you with an itemized list of deductions or refund your deposit within 21 days.
For $1400, it’s not worth it. I think you’ll spend more on the trip back.

talk to a CA lawyer and see if you can include your travel expenses in the suit – assuming the lawyer says you have a case.

You’d be surprised what a letter from an attorney would do for many situations. I’m sure being a physician you can afford an attorney that can do this for you. The last time I had a letter written on my behalf I paid ZERO because I am a member of a service that provides that as one of the benefits. But before having this service I paid $75 and that was half price….I think the attorney felt sorry for me because I didn’t have physician money.

Honestly, why are you asking if you ruined the carpet? If the power cleaner didn’t do it, she will need to get a whole new carpet especially if she wants to sell it. I would have her show the receipts from her last carpet purchase….I bet she didn’t pay $1400. You could match that price. If she said no, I guess you could speak with her about a cheaper carpet so you get some security deposit back. We actually got a carpet at Building 19 (it was actually nice) and had someone put it in. It only cost $500-600. If she knows she has your deposit she will try to get a better carpet. Get the receipt and if she doesn’t agree you will have to take her to court or forget about it. You can have an “agent” of yours represent you in court….you don’t even have to be there. Check it out.
