Can I get my 1st months rent and deposit back?

Here is the deal, I paid deposit and decided to pay 1st months rent as well. We have a receipt for this. Come the day before we were scheduled to move, our vehicle broke down. In this case we were not able to move yet, because the vehicle had broke down and we lived 4 hours away and had no means for transportation. We had to return our uhaul and everything. Note that we didn’t even have keys to this apartment.

Have you already signed the lease? If so, you are obligated to continue paying rent through the end of the lease. Given the circumstances, you may want to try talking to the landlord and explaining the situation. Since you haven’t moved in, it’s possible you can get your money back and the place can be rented to someone else.
Most holding deposits are non-refundable after 72 hours. Surly they’d give you your 1st month’s rent back since you never moved-in/received keys. Have you decided not to move in all together? If they have another vacant unit, maybe they can transfer your deposit & 1st mo rent to another vacant unit or to a unit that is expected to become vacant in the near future?
You won’t get your deposit back, as it’s going to be used to reimburse the landlord for the time that the apartment was off the market to hold it for you.
The first months rent, if you haven’t signed a lease of any sort or officially moved in, you should get that back.
