We put down the deposit with intention to buy the home during the 3 month lease. After finding out we couldn’t get financing, we decided not to rent a home that was on the market. Nothing was signed and we had the impression that the money was toward the deposit, not to hold the home from being leased. The agency says that we made a verbal agreement and they are keeping the money. Is this legal?

Tenant owes me back rent from Oct and November. Told me he’s moving out by end of Dec. I plan to sue him in small claims court for the back rent. Should I play save and go through the eviction process? I already gave him Pay or Quit Notice. Can one go through eviction and small claims court process at the same time? What would be a better way? I am on a month-to-month lease. My landlord is moving into my duplex in order to save money. I am all paid up for this month, but gave him my last month’s rent prior to occupancy. I also paid a seperate security deposit which he’s promised to get back to me within 30 days of vacating the property.

We moved out in Oct. 2006, for the last few weeks our last landlord is trying to tell us we owe him “back rent” and he kept the security deposit for damages. When we moved in it took me 2 weeks to clean it so we could move in . The past tenants were put in jail and there were piles of garbage in the house.
For 18 months he would not fix exposed wires, no back door”for 6 months”, broken drawers, mushrooms and sex stuff painted on the walls up-stairs, and the floor in front of the sink where my foot went thru. When we moved out the landlord said “this is the cleanest apt. anyone has ever left me with.” For 2 months after we asked for a final tally and were ignored. now almost 10 months later we were told he was keeping the deposit for the damages and we owe him back rent. He continues to harrass my wife at work because he know’s where I would tell him to go.
